TERMS AND CONDITIONS AGREEMENT
Homesay India
This Terms and Conditions Agreement (“Agreement”) is made and entered into between Homesay India, hereinafter referred to as the “Company”, and the Customer/Client, hereinafter referred to as the “Client”.
By accepting the quotation, making any payment, or allowing commencement of work, the Client agrees to be legally bound by the terms set forth below.
1. SCOPE OF SERVICES
1.1 The Company shall provide home-related services including painting, cleaning, waterproofing, repair, renovation, and associated services.
1.2 The detailed scope of work shall be strictly as per the approved quotation.
1.3 Any work not expressly mentioned in the quotation shall be treated as additional work and charged separately.
2. QUOTATION AND PRICING
2.1 All quotations are based on site inspection or information provided by the Client.
2.2 The Company reserves the right to revise the quotation in case of:
Change in site conditions
Discovery of hidden defects (e.g., seepage, cracks)
2.3 The quotation shall remain valid for a period of 7 (seven) days unless otherwise specified.
2.4 Applicable taxes shall be charged extra unless explicitly stated.
3. PAYMENT TERMS
3.1 Booking Advance
The Client shall pay 10% (ten percent) of the total quotation amount as advance for confirmation of booking. No booking shall be confirmed without receipt of advance payment.
3.2 Stage-wise Payments
The remaining payment shall be made as per the following schedule:
40% (forty percent) prior to commencement of work or upon material delivery
40% (forty percent) upon completion of approximately 50–60% of work
10% (ten percent) upon final completion and prior to handover
3.3 Delay in Payment
In case of delay in payment beyond agreed timelines:
The Company reserves the right to suspend work without notice
Any delay caused due to non-payment shall not be attributable to the Company
3.4 Non-Payment
Failure to clear dues may result in:
Withholding of services or materials
Cancellation of warranty
Initiation of legal recovery proceedings
4. MATERIALS AND QUALITY
4.1 Materials shall be used as per the agreed brand or package.
4.2 Any change requested by the Client shall be subject to additional charges.
4.3 Minor variations in shade, texture, or finish shall not be considered defects.
4.4 The Company shall not be responsible for manufacturer defects but may assist in coordination.
5. EXECUTION AND TIMELINE
5.1 Timelines provided are indicative and subject to change.
5.2 Delays may occur due to factors beyond control including but not limited to weather, site readiness, or material availability.
5.3 The Company shall not be liable for such delays.
6. CLIENT OBLIGATIONS
6.1 The Client shall provide uninterrupted access to the site.
6.2 The Client shall ensure availability of water, electricity, and safe working conditions.
6.3 The Client shall secure all valuables and movable items prior to commencement of work.
6.4 Necessary permissions from building/society authorities shall be obtained by the Client.
7. ADDITIONAL WORK
7.1 Any work beyond the agreed scope shall require prior approval of the Client.
7.2 Such work shall be chargeable and payable immediately or as agreed.
8. CANCELLATION AND REFUND
8.1 Cancellation prior to commencement may lead to partial or full forfeiture of advance.
8.2 Cancellation after commencement shall be charged proportionately based on work completed and materials utilized.
8.3 Refunds, if applicable, shall be processed within 5–7 working days.
9. WARRANTY
9.1 Warranty shall be applicable only if expressly mentioned in the quotation.
9.2 Warranty shall cover only workmanship defects.
9.3 Warranty shall not cover:
Seepage or water leakage
Structural defects
External damage or misuse
10. DAMAGE AND LIABILITY
10.1 Any damage must be reported immediately during execution.
10.2 The Company shall not be liable for claims raised after completion of work.
10.3 Liability, if any, shall be limited to rectification of work and not monetary compensation.
11. SUSPENSION AND TERMINATION
11.1 The Company reserves the right to suspend or terminate services in case of:
Non-payment
Unsafe site conditions
Non-cooperation by the Client
12. FORCE MAJEURE
The Company shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, government restrictions, or unforeseen circumstances.
13. COMPLETION AND HANDOVER
13.1 Final inspection shall be conducted upon completion of work.
13.2 Any minor touch-ups shall be completed prior to handover.
13.3 Final 10% payment must be cleared before handover.
13.4 Post handover, the work shall be deemed accepted by the Client.
14. DISPUTE RESOLUTION AND JURISDICTION
14.1 Any dispute arising shall be subject to amicable resolution.
14.2 Failing such resolution, the matter shall be subject to the jurisdiction of courts located in Ahmedabad, Gujarat.
15. ACCEPTANCE
By making payment, approving quotation, or allowing work to commence, the Client confirms that they have read, understood, and agreed to all the terms and conditions stated herein.
